Mr Balfour was a civil servant in Ceylon. When he returned to England on leave with his wife, she became ill and was advised to remain in England. Before returning to Ceylon, Mr Balfour promised to pay his wife £30 per month until she could rejoin him. The couple later separated and Mrs Balfour sued to enforce the promise.
