President John Adams appointed William Marbury as a justice of the peace in the final days of his administration. The commission was signed and sealed but not delivered before Thomas Jefferson took office. Secretary of State James Madison refused to deliver the commission. Marbury filed suit directly in the Supreme Court seeking a writ of mandamus to compel delivery.
